要旨 [Key Points]

行为人明知系国家管制的麻醉药品、精神药品，出于非法用途走私、贩卖的，应当以走私、贩卖毒品罪追究刑事责任。行为人出于非法用途，以贩卖为目的非法购买国家管制的麻醉药品、精神药品的，应当认定为贩卖毒品罪既遂。检察机关应当综合评价新型毒品犯罪的社会危害性，依法提出量刑建议。

Where an actor knows that a medicinal product is narcotic drug or psychotropic drug under state control but still smuggles or traffics it for illegal purposes, the actor shall be subject to criminal liability for committing a crime of drug smuggling and trafficking. Where an actor illegally purchases narcotic drugs or psychotropic drugs under state control for the illegal purpose of trafficking, the acts of the actor shall be determined as an accomplished crime of drug trafficking. The procuratorial organ shall comprehensively evaluate social harms brought by a crime involving new-type drugs and legally raise sentencing proposals.

要旨 [Key Points]

行为人明知系国家管制的麻醉药品、精神药品而向他人的饮料、食物中投放，欺骗他人吸食的，应当以欺骗他人吸毒罪追究刑事责任。对于有证据证明行为人为实施强奸、抢劫等犯罪而欺骗他人吸食麻醉药品、精神药品的，应当按照处罚较重的罪名追究刑事责任。检察机关应当加强自行补充侦查，强化电子数据等客观性证据审查，准确认定犯罪事实。

Where an actor knows that it is a narcotic drug or psychotropic drug under state control, puts it in the beverage or food of others, and deceives others into taking it, the actor shall be subject to criminal liability for a crime of deceiving others into taking drugs. Where there is evidence proving that an actor deceives others into taking a narcotic drug or psychotropic drug for the purpose of committing rape, robbery, or other crimes, the actor shall be subject to criminal liability according to the charge with a heavier penalty. The procuratorial organ shall strengthen supplementary investigation on its own, intensify examination of electronic data and other objective evidence, and accurately ascertain criminal facts.

何某贩卖、制造毒品案

要旨 [Key Points]

行为人利用原生植物为原料，通过提炼等方法制成含有国家管制的麻醉药品、精神药品的物质，并予以贩卖的，应当认定为贩卖、制造毒品罪。办理新型毒品犯罪案件，检察机关应当依法引导侦查机关开展侦查实验，查明案件事实。

Where an actor produces substance of a narcotic drug or a psychotropic drug under state control by using a type of original plant as the raw material and sells such substance, the aforesaid acts shall be determined as a crime of drug trafficking and manufacture. In the handling of a case involving a new-type drug-related crime, the procuratorial organ shall guide the criminal investigation organ in carrying out investigative testing in accordance with the law and ascertaining the case facts.
